Stay Beachside | Website Terms of Use

These terms govern your use of staybeachside.com.au. They are separate from our Booking Terms and Conditions, which govern any booking you make. Where you make a booking, both apply, and the Booking Terms and Conditions prevail to the extent of any inconsistency.

1. Who we are

staybeachside.com.au (the site) is operated by Stay Beachside Pty Ltd (ABN 67 687 868 391), trading as Stay Beachside, a licensed Queensland real estate agency.

In these terms, “we”, “us” and “our” means Stay Beachside, and “you” means anyone who accesses or uses the site.

2. Acceptance

By accessing or using the site you agree to these terms. If you do not agree, please do not use the site.

We may update these terms at any time by publishing an updated version on the site. The version in force is the one published at the time you use the site.

3. Using the site

3.1 You may use the site to browse our properties, make and manage bookings, and enquire about our services.

3.2 You must not:

  • use the site for any unlawful purpose, or in any way that breaches these terms;
  • copy, reproduce, republish, scrape, frame or redistribute any part of the site or its content for commercial purposes without our written consent;
  • use any automated system, robot or data-mining tool to access, extract or index the site, except for search engines operating in the ordinary course;
  • attempt to gain unauthorised access to the site, its servers, or any account or data held on it;
  • introduce any virus, malicious code or other harmful material; or
  • submit content or enquiries that are false, misleading, defamatory, offensive, or that infringe the rights of any person.

3.3 We may suspend or withdraw access to the site, or to any part of it, without notice.

4. Accounts and enquiries

4.1 Where you provide information through a booking, enquiry or newsletter form, you must ensure that it is accurate and that you are entitled to provide it.

4.2 Where the site provides an account or login, you are responsible for keeping your credentials secure and for activity carried out under your account. Tell us promptly if you believe your account has been accessed without your authority.

5. Property listings, availability and pricing

5.1 We take care to describe and photograph our properties accurately, and to keep availability and rates current. Images are indicative and minor variations may occur as properties are refreshed and furnishings are replaced.

5.2 Rates and availability shown on the site are subject to change until a booking is confirmed. Nothing on the site is an offer capable of acceptance, and a booking is only confirmed in accordance with our Booking Terms and Conditions.

5.3 Where an error in a description, an image, a rate or availability is obvious and material, we may correct it, and where a booking is affected we may cancel it and refund you in full.

6. Intellectual property

6.1 All content on the site, including text, photographs, video, graphics, layout, the Stay Beachside name and logo, and the compilation of the site, is owned by us or licensed to us and is protected by Australian and international copyright and trade mark law.

6.2 You may view, download and print content from the site for your own personal, non-commercial use. All other use requires our prior written consent.

6.3 Nothing on the site grants you any licence or right in any trade mark or other intellectual property of ours or of any third party.

6.4 If you send us photographs, reviews or other material, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish it in connection with our business, and you confirm that you are entitled to grant that licence.

7. Third-party links and platforms

7.1 The site may link to third-party websites and booking platforms, including Airbnb, Booking.com and VRBO. Those sites are not under our control. We provide the links for convenience only and we are not responsible for their content, their availability, or the products and services offered on them.

7.2 Where you make a booking through a third-party platform, that platform’s terms and privacy practices apply to that booking in addition to our Booking Terms and Conditions.

8. Availability of the site

8.1 We will use reasonable efforts to keep the site available, but we do not guarantee that it will be uninterrupted, error free, secure, or free of viruses or other harmful components.

8.2 We are not responsible for any failure or delay in your access to the site caused by your internet connection, your device, your browser, or by any telecommunications or hosting service outside our control.

8.3 We may carry out maintenance or make changes to the site at any time, and may do so without notice.

9. Liability

9.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

9.2 Subject to clause 9.1, and to the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the site, or from your reliance on any information on it, including any indirect or consequential loss.

9.3 Information on the site about the Gold Coast, its beaches, attractions, transport and local services is provided as general information only. It may change, and we do not warrant that it is complete or current.

10. Privacy

We collect and handle personal information in accordance with our Privacy Policy, available at staybeachside.com.au/privacy-policy.

11. General

11.1 These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.

11.2 If any provision of these terms is found to be invalid or unenforceable, that provision is severed and the remainder continues in full force.

11.3 A failure by us to enforce any provision of these terms is not a waiver of that provision.
